INTRODUCTION

Welcome to the FreshKon Club reward program. This is a reward program specially designed for our valued customers. By registering as a FreshKon Club member and accept the terms of use, user can enjoy member benefits including welcome gift, birthday treat, exclusive deals, loyalty point rewards and many more.

In addition, with every genuine purchase of FreshKon product, an eligible member is allowed to participate in loyalty point campaign to collect points that can be used for product in kind, voucher/offer redemption and etc.

ACCEPTANCE OF TERMS

All services are provided to you by Oculus (M) Sdn Bhd under the terms of use and Privacy Policy set forth in this document. By completing the registration process, you are indicating your agreement to be bound by the following terms.


MEMBER ACCOUNT, PASSWORD AND SECURITY

You are responsible for maintaining the confidentiality of your chosen password and account, and are fully responsible for all activities that occur under your password or account.


NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.


MODIFICATIONS TO SERVICE

Oculus (M) Sdn Bhd reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Oculus (M) Sdn Bhd shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.


TERMINATION

Oculus (M) Sdn Bhd reserves the right to immediately terminate your account, any associated email address, and access to the Service under certain circumstances and without prior notice.


DISCLAIMER OF WARRANTIES

You expressly understand and agree that:

  • The site contains material which is derived in whole or in part from material supplied by Oculus (M) Sdn Bhd. No material may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in anyway. Modification of the materials or use of the materials for any other purpose is a violation of propriety rights. The use of any such materials on any other web is prohibited without Oculus (M) Sdn Bhd’s express written consent.
  • Oculus (M) Sdn Bhd makes no warranty that (i) The service will meet your requirements, (ii) The service will be uninterrupted, timely, secure, or error-free, (iii) The results that may be obtained from the use of the service will be accurate or reliable, (iv) The quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.

LIMITATION OF LIABILITY

You expressly understand and agree that Oculus (M) Sdn Bhd shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages resulting from: (i) The use or the inability to use the service; (ii) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) Unauthorized access to or alteration of your transmissions or data; (iv) Statements or conduct of any third party on the service; or (v) Any other matter relating to the service.


COLLECTION OF INFORMATION

By registering as a FreshKon Club member, you agree to give consent to Oculus (M) Sdn Bhd in retaining personal data for the purpose of notifying by email, post, telephone calls, SMS, facsimile, visits and/or by any other means of any events, contests, product launches, sales promotions or updates offered by Oculus (M) Sdn Bhd. We may collect personal data about you that you provide to us while using FreshKon Club platform and information about how you use FreshKon Club platform including when you open your user account ('User Account'), visit FreshKon Club platform or confirm on any intended services or using the services.


RESTRICTIONS ON USE OF MATERIALS

The site contains material which is derived in whole or in part from material supplied by Oculus (M) Sdn Bhd. No material may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in anyway. Modification of the materials or use of the materials for any other purpose is a violation of propriety rights. The use of any such materials on any other web is prohibited without Oculus (M) Sdn Bhd’s express written consent.

 

LOYALTY PROGRAM

1. Member will receive loyalty point reward within 3 - 6 working days based on their submission date of the proof of purchase.

2. The points collected valid for 1 year from issuance date, first in first out basis. Accumulated points must be used up prior to the point expiry date or it will be forfeited.

3. Member must submit the proof of purchase within 1 month from the receipt issuance date.

4. The points rewarded will be based on the total spent on FreshKon products only.

5. Oculus (M) Sdn Bhd reserves the right to reject, amend, withdraw, adjust or forfeit members’ point in view of the below:

  • Online receipt: uncompleted order includes but not limit to refund order, return order, cancelled order, good exchange, purchase with and other foreseeable and unforeseeable order conditions that might occur along the way.
  • Retail outlet receipt: unauthorised receipt, duplicate receipt, hand-written receipt, receipt without proper receipt ID/product description/pricing/merchant details, other foreseeable and unforeseeable conditions that might occur along the way.
  • Improperly point credited: under any unforeseeable condition that point was fraudulently obtained or issued to the user’s account, Oculus (M) Sdn. Bhd. reserve the right to adjust or cease the point.
  • Misconduct of behaviour and disqualified receipt: Repeated receipt submission, shared receipt, fake receipt, modified receipt, expired receipt (definition: date of receipt issuance is over/more than 1 month), receipt with payment in non-monetary term (such as points redemption, voucher redemption), receipt in non-MYR currency, receipt from other country, receipt without FreshKon product details, receipt without proper merchant details, credit card receipt and other types of fraudulent conduct and receipt that subject to clarification.
  • Fraudulent account: Oculus (M) Sdn. Bhd. reserves the right to terminate the account with suspicious activities and cancel the available point under the account.

REFERRAL PROGRAM

1. FreshKon Club may offer members the chance to earn points, when they invite friends to become members of FreshKon Club and those friends registered through an authorized FreshKon invitation channel (e.g. an invitation sent through FreshKon website, Facebook or another social media channel as supported by FreshKon).

2. You may only earn points via FreshKon Club authorized member invite mechanisms. Referrals outside of FreshKon Club will not result in any points rewarded. These points are not transferable, may not be auctioned, bartered or sold, and may not be pooled with other members.

3. Points will be rewarded to you within 1-2 days of one of your qualifying invitees completing his or her new member registration.

4. You agree that having multiple FreshKon Club Accounts is a violation of this Terms of Use and that sending invites to alternate email addresses or accounts or otherwise attempting to circumvent the FreshKon Club Referral Program system may, without limiting any of Oculus (M) Sdn Bhd other rights or remedies, result in forfeiture of your membership and all points in your FreshKon Club Account.

5. Oculus (M) Sdn Bhd reserves the right to modify the values and rewards of the FreshKon Club Referral Program based on each user's activity.

6. Oculus (M) Sdn Bhd reserves the right to void referrals and points earned if it is suspected that the referrals or points were earned in a fraudulent manner, in a manner that violates this Terms and Conditions or in a manner otherwise not intended by Oculus (M) Sdn Bhd.


FRESHKON® CLUB REWARD POINTS

Points collected throughout the FreshKon Club program will be recorded in the Member’s Account and it can be used for redemption of gifts, goods, offers, activities or services provided as part of the promotional and incentive program. Selling, transferring or assigning of points to other party is strictly prohibited. Oculus (M) Sdn Bhd. reserves the right to terminate the account or withdraw points issued if suspicious transaction or any dispute is found.
